In these Terms, the following words have the meanings set out below:

  • "We", "Us", "Our" — Mutiara Adil, a legal practice registered and operating in Malaysia from Jalan Damansara 78, 60000 Kuala Lumpur.
  • "You", "User" — any person who visits our website or engages our legal services.
  • "Services" — the legal and advisory services provided by Mutiara Adil, including estate planning consultations, probate and administration, and inheritance dispute resolution.
  • "Website" — the website accessible at mutiaraadil.blog and any associated pages.
  • "Engagement Letter" — the written agreement between Mutiara Adil and a client setting out the scope, fees, and terms of a specific legal matter.
  • "Content" — all text, materials, documents, and information published on or made available through our Website.

2. Acceptance of Terms

By accessing or using our Website, or by engaging our Services, you confirm that you have read and agree to be bound by these Terms. If you do not agree, please discontinue use of the Website and do not engage our Services.

Our Services are intended for adults aged 18 and over who have legal capacity to enter into binding agreements under Malaysian law. By using this Website or engaging our Services, you represent that you meet this requirement.

Where Services are engaged on behalf of a family group or estate, the individual making contact represents that they have appropriate authority to do so.

3. Our Services

Mutiara Adil provides the following legal services in Malaysia:

  • Estate Planning Consultation (RM 280) — a structured consultation to discuss and document your estate planning intentions, including will preparation guidance, asset nomination, and related matters.
  • Probate and Administration (from RM 685) — legal assistance for families administering an estate, including applying for Letters of Administration or Grant of Probate, liaising with financial institutions, and transferring assets to beneficiaries.
  • Inheritance Dispute Resolution (from RM 1,495) — facilitation, negotiation, and representation in matters where an inheritance is contested, with the aim of reaching fair outcomes with as little adversarial process as the circumstances allow.

Our Services are provided in accordance with Malaysian law and are subject to the terms set out in a separate Engagement Letter for each matter. The indicative fees above are starting prices; the total fee for a given matter will be confirmed in writing before work commences.

We operate primarily in Malaysia and cannot advise on matters governed by the laws of other jurisdictions, though we can assist with cross-border estate matters where a Malaysian component exists.

4. Website Use

You may use our Website for lawful purposes only. You agree not to:

  • Use the Website in any way that breaches Malaysian law or any applicable regulation
  • Attempt to gain unauthorised access to the Website's infrastructure or data
  • Submit false, misleading, or fraudulent information through any form or communication channel
  • Reproduce, distribute, or commercially exploit our Website Content without written permission
  • Use automated means to scrape, harvest, or index our Website Content

The Website is intended as a general information resource and a means of making initial contact with us. It does not constitute legal advice. No solicitor-client relationship is formed by your use of the Website alone.

5. Fees and Payment

All fees are quoted and payable in Malaysian Ringgit (RM). The fee for each matter is confirmed in the Engagement Letter before work begins. We accept payment by bank transfer, online banking, and cheque.

For probate, administration, and dispute resolution matters, we may request an initial deposit before commencing work. The remaining balance is invoiced as the matter progresses or on completion, as agreed in the Engagement Letter.

The RM 280 estate planning consultation fee is payable before or at the time of the consultation. If you need to reschedule, we ask for at least 48 hours' notice. Cancellations with less than 48 hours' notice may not receive a refund of the consultation fee.

Disbursements (court filing fees, Land Office charges, and similar out-of-pocket costs) are charged separately at actual cost and will be itemised in our invoices.

6. Confidentiality

We treat all information shared with us in the course of a client engagement as strictly confidential in accordance with our professional obligations under the Legal Profession Act 1976 and the rules of the Malaysian Bar.

We will not disclose your information to third parties except where necessary to carry out your instructions (for example, filing documents with a court or authority), where you have consented, or where we are required to do so by law or court order.

General enquiries submitted through our website contact form are handled with the same care, though they do not yet attract full legal professional privilege until a formal engagement is established.

7. Intellectual Property

All content on this Website — including text, layout, graphics, and design — is owned by or licensed to Mutiara Adil. You may view, download, and print pages for your personal, non-commercial use. You may not reproduce, republish, or redistribute any content without our prior written consent.

Documents we prepare for you in the course of a legal engagement (such as a will, deed, or court filing) belong to you once all fees have been paid in full. Our internal working files and precedents remain our property.

8. Disclaimers

The content on this Website is provided for general information only. It does not constitute legal advice and should not be relied upon as such. No two estates or family situations are alike; you should consult a qualified legal practitioner before acting on any information here.

While we aim to keep the information on our Website accurate and current, we do not warrant that it is free from error or that it reflects the most recent changes in Malaysian law.

Outcomes in legal matters depend on many factors outside our control, including court timescales, the response of other parties, and changes in law or policy. We do not make assurances as to the outcome of any matter.

9. Limitation of Liability

To the extent permitted by Malaysian law, our total liability to you in connection with Services provided shall not exceed the total fees paid to us in respect of the matter to which the liability relates.

We shall not be liable for any indirect, consequential, or special loss, including loss of opportunity, loss of anticipated savings, or family relationship damage arising from the conduct of a legal matter, except where such liability cannot be excluded by law.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded under Malaysian law including the Legal Profession Act 1976.

10. Termination of Engagement

Either party may terminate an engagement by giving written notice. If you terminate, you will be invoiced for work completed and disbursements incurred up to the date of termination. We will transfer your file to you or to another solicitor of your choosing.

We may also cease acting for you if there is a conflict of interest, if we are unable to obtain adequate instructions, or if professional rules require us to withdraw. In such circumstances, we will give you reasonable notice and assist with the transition of your matter where possible.

Termination of an engagement does not affect the provisions of these Terms that, by their nature, should continue after termination (including confidentiality, intellectual property, and limitation of liability).

11. Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Malaysia, with Kuala Lumpur as the preferred venue.

Before commencing formal proceedings, both parties agree to attempt to resolve any dispute through good-faith discussion. If a matter cannot be resolved informally, we encourage the use of mediation as a first step, which is consistent with the approach we recommend to our own clients in inheritance disputes.

Complaints about our service may also be referred to the Malaysian Bar's complaints procedure. Details are available at www.malaysianbar.org.my.

12. General Provisions

  • Entire Agreement: These Terms, together with the Engagement Letter for your specific matter, constitute the entire agreement between us and supersede any prior representations or understandings.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
  • Waiver: Our failure to enforce any provision of these Terms in a particular instance does not constitute a waiver of our right to enforce it in the future.
  • Assignment: You may not assign your rights or obligations under these Terms without our written consent. We may assign our obligations to another suitably qualified practitioner with reasonable notice to you.
  • Force Majeure: We will not be liable for delays or failures in performance caused by circumstances outside our reasonable control, including court closures, natural disasters, or significant changes in the law requiring us to revise our approach.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated to active clients by email.

Your continued use of the Website or ongoing engagement of our Services following any update constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
